Terms of Service

1. The Service

Cruz Totes rents reusable moving totes and related equipment to customers throughout Santa Cruz County, California, with regional delivery and pickup available in select surrounding counties as offered at checkout. We deliver totes to your specified address and retrieve them when your rental period ends. Our service is intended for personal or business moving and storage use.

2. Eligibility

You must be at least 18 years old to place a rental order. By booking, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Bookings, Pricing, and Payment

All prices, packages, rental periods, and fees are displayed at the time of booking. By completing checkout, you authorize us to charge your payment method for the amounts shown. Promotional pricing applies only as stated at the time of the offer.

4. The Rental Agreement

The physical rental itself, including delivery, pickup, deposits, care of totes, damage, loss, late returns, and cancellations, is governed by our Rental Agreement, which you accept at checkout and receive with your booking confirmation. If these Terms and the Rental Agreement conflict on any rental matter, the Rental Agreement controls.

5. SMS Communications

By providing your mobile phone number during booking, you agree that Cruz Totes may send you SMS or MMS messages related to your order, including delivery confirmations, pickup reminders, and order updates.

• Message frequency: Messages are tied to your specific order and will not exceed what is necessary to coordinate your rental.
• Marketing messages: We will not send you marketing or promotional text messages unless you separately opt in to receive them.
• Opting out: Consent is not required to purchase. You may opt out at any time by replying STOP to any message or by emailing hello@cruztotes.com. You will receive one final confirmation of your opt-out.
• Help: Reply HELP or contact us at hello@cruztotes.com for assistance.
• Carrier fees: Cruz Totes does not charge for SMS messages, but standard message and data rates from your mobile carrier may apply.
• Accuracy of number provided: You represent that the mobile number you provide is yours and that you are authorized to enroll it. If your number changes, notify us promptly. You agree to indemnify Cruz Totes from any claims arising from your provision of a number you do not own or control.
• Carriers: Supported by AT&T, T-Mobile, Verizon, and most major US carriers. Carriers are not liable for delayed or undelivered messages.

6. Acceptable Use

You agree not to use our website or service to:

• Violate any applicable law or regulation
• Submit false, misleading, or fraudulent booking information
• Interfere with or disrupt the operation of the website, including through automated scraping, bots, or attempts to bypass security measures
• Infringe the rights of any third party

We may refuse or cancel service to anyone who violates these terms.

7. Intellectual Property

All content on our website, including text, logos, images, graphics, and design, is the property of Cruz Totes or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written permission.

8. Temporary Closure

Cruz Totes reserves the right to temporarily suspend operations in the event of a state or national emergency, natural disaster, severe weather, disease epidemic or pandemic, or other circumstances beyond our reasonable control. In such cases, we will contact affected customers and work to reschedule or issue refunds as appropriate.

9. B2B and Realtor Programs

Realtors, moving companies, and other business partners participating in a Cruz Totes partner program are additionally bound by our Partner Agreement, provided at enrollment. Cruz Totes reserves the right to modify or discontinue partner programs with reasonable notice. If these Terms and the Partner Agreement conflict on any partner matter, the Partner Agreement controls.

10. Disclaimer of Warranties

Our website and service are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Cruz Totes disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Cruz Totes's total liability for any claim arising from your rental or your use of our website is limited to the amount you paid for the transaction giving rise to the claim, or $100 if no transaction occurred.

We are not liable for indirect, incidental, or consequential damages, including damage to items packed inside the totes, delays caused by circumstances outside our control, or losses resulting from your failure to follow these terms.

12. Indemnification

You agree to indemnify and hold Cruz Totes harmless from any claims, damages, or expenses arising from your misuse of the totes, your violation of these terms, or your negligence during the rental period.

13. Governing Law

These terms are governed by the laws of the State of California. Any disputes will be resolved in Santa Cruz County, California.

14. Disputes

If you have a concern or dispute, please contact us first. We would rather resolve it directly than through formal channels, and we will make a good faith effort to address any issue promptly.

15. Changes to These Terms

We may update these terms from time to time. We will post the updated version here with a revised date. Continued use of our service after changes take effect constitutes acceptance of the revised terms.

16. Severability and No Waiver

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

17. Entire Agreement

These Terms, together with the Rental Agreement, the Privacy Policy, and, for program participants, the Partner Agreement, constitute the entire agreement between you and Cruz Totes regarding our service.
